Even though in some areas inventory has increased over the last few weeks much of the country is in a seller's market. If you, as a buyer, are facing a market with high demand and low inventory that requires buyers to bid over asking, waive inspections, and add sweeteners like paying the seller's side of the transfer tax you may be in a situation where paying your own agent will make your offer stand out and win.  With that being said, seller's can still offer compensation when the market dictates that practice. The major change is that the offered compensation will no longer be advertised through the MLS if the settlement is approved. .

Contrary to some misconceptions, the services of a buyer’s agent are not without cost, though typically as mentioned, the seller’s broker covers the commission. I believe in full transparency regarding compensation and I always discuss all potential costs upfront. This ensures there are no surprises, allowing everyone's focus to be on finding your ideal home. You should find a local agent that has the same beliefs. Additionally, your partnership should be formalized through a buyer agency agreement, which clarifies the mutual commitments and sets the stage for a successful collaboration. Entering into a buyer representation agreement is more than a mere formality; it's a specific definition of duties in the service of finding your ideal property. This agreement outlines the services you can expect from an agent, ensuring a professional standard that protects both parties throughout the home buying process. A buyer representation agreement is a professional standard that sets clear expectations for your working relationship. It also outlines the agents obligations to a buyer as their client and clarifies what they can expect from their agent. It ensures that an agent can fully commit their resources and expertise to find the best property for a buyer.  Agreements vary by state, however they should include details on responsibilities, compensation, and term of the agreement. The settlement would make these agreements mandatory for any agent and buyer touring homes if approved.
